These Terms of Service (“Terms”) govern your access to and use of our Discord bot “Sparkle” (the “Bot”). Please read these Terms carefully before using the Bot.
By adding, inviting, or using the Bot in any Discord server or direct message, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Bot.
You agree to use the Bot only for lawful purposes and in accordance with these Terms, applicable laws, and Discord’s Terms of Service and Community Guidelines. You are solely responsible for your interactions with the Bot.
You agree not to engage in any of the following prohibited activities:
Our Bot may allow you to provide, submit, or generate content, such as character information, inventory item details, game tracking data, custom signatures, or other data necessary for bot features (“User Content”).
You retain ownership of your User Content. However, by providing User Content to the Bot, you grant us a worldwide, non-exclusive, royalty-free license to store, process, display, and use your User Content solely as necessary to provide and maintain the Bot’s functionality and services to you.
You are solely responsible for your User Content and the consequences of providing or sharing it through our Bot. You represent and warrant that:
We reserve the right, but are not obligated, to review and remove any User Content that violates these Terms or that we find objectionable in our sole discretion, without prior notice.
Excluding User Content, the Bot itself, source code, features, functionality, are and will remain the exclusive intellectual property of the Bot owner(s)/developer(s).
THE BOT IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. USE OF THE BOT IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE BOT IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE BOT WILL MEET YOUR REQUIREMENTS; THAT THE BOT WILL BE AVAILABLE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR THAT ANY ERRORS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE BOT OWNER(S)/DEVELOPER(S) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE BOT; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE BOT; (III) ANY CONTENT OBTAINED FROM THE BOT; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
Our Bot is hosted on Cybrancee, a third-party service provider. Your use of the Bot is inherently dependent on Discord’s platform and may interact with Cybrancee’s hosting services. Your interactions with these third parties are subject to their respective terms of service and privacy policies. We are not responsible for the content, privacy policies, or practices of Discord, Cybrancee, or any other third-party services.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice (e.g., via a Bot command, support server announcement, or updating the “Last Updated” date). What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Bot after any revisions become effective, you agree to be bound by the revised terms.
We may terminate or suspend your access to the Bot immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. Upon termination, your right to use the Bot will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
